There have already been (roughly) a half-dozen similar cases over the years.
It's amazing how shameless both the OEMs and Microsoft Corp. are about
honouring the terms of their own EULA (specifically, the clause that
very clearly says that you _must_ return the OS for a refund if you
don't accept its licence terms) unless you drag them through either
endless months of bureaucracy or the courts.
It's basically the market consequence of the co-op marketing money.
The OEMs can't survive without it, so they drag their feet on anything
that could interfere with troublefree money flow. (If you were fronting
50% of their product line's marketing budget, the OEMs would be nice to
you, too.)
