I think SuSE is GPLed (except for any commercial software in their
distro).  They just don't make ISO CD images available, so that 
downloading their product for free is a little more trouble,
so that maybe _somebody_ will _buy_ it (I do) and they can stay
in business.

I'm sure those goons just downloaded the software from SuSE's
website like anybody else.  SuSE has no control over what
they do.  And they're certainly not going to go after them
about posting an ad to a mailing list.  Especially during a
discussion of where to buy downloaded Linux distros cheap...
