Not necessarily that. But take a look at the typical commercial 
shrink-wrap license agreement -- a company could conceivably 
release a virus within their copy-protected software -- business (or 
user) runs it, loses its valuable data. Business (or user) cannot
sue the company for negligence, but the company can sue the business
for reverse-engineering the virus out of the software.

Of course, this scenario isn't likely -- but it is possible.
